The vast majority of wild birds is protected by law under the Wildlife and Countryside Act 1981 and this protects wild birds, their nests and their eggs. However, there are some notable exemptions to this law. DEFRA (Department of the Environment, Food & Rural Affairs), the governing body of the Wildlife and Countryside Act), recognise that there are some species that do cause a nuisance and that controls need to be put in place to stop the damage and contamination that they can cause.
The species exempt from the law are:
Greater Black-backed gull
Lesser Black-backed gull
This means that under a DEFRA general license, bird controls and measures can be put into place to counteract any problems that they may be causing.
With this said it is still illegal to cause these birds any suffering and only humane methods of bird control will be tolerated. Understanding the legalities of bird control is crucial so that no harm is caused.
